在英文合同中，经常会出现without prejudice to这种表达方式。这里的“prejudice”指的是“权利关系中的负面利益”。在进行某项行为时，作为其代价，可能会发生需要承担负面利益的事态时（如在行使某项权利时，其行为可能会视为放弃其他的权利时），如果需要对其进行事先回避，便会使用这一phrase。
